1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the HomeFlex platform, website, and services (collectively, the "Services") operated by HomeFlex ("we," "us," or "our"). By creating an account, submitting a listing, or otherwise using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not access or use the Services.

2. About HomeFlex

HomeFlex is a real estate technology platform and is not a real estate brokerage. We provide technology tools and a customer experience that help homeowners list, market, and manage the sale of their property. For customers purchasing a Flat-Fee MLS Listing plan for properties located in North Carolina, MLS listing services are provided through our licensed brokerage partner, Oak & Elm Realty Group LLC, a North Carolina licensed real estate brokerage.

HomeFlex and Oak & Elm Realty Group LLC are separate business entities. HomeFlex does not provide real estate brokerage, legal, tax, or financial advice.

3. Eligibility & Your Account

You must be at least 18 years of age and legally able to enter into a binding contract to use the Services. You agree to provide accurate, current, and complete information when creating your account and to keep that information updated. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

HomeFlex is designed exclusively for homeowners selling property they own. Licensed real estate brokers, agents, teams, or other real estate professionals may not use HomeFlex to market, list, or manage properties for clients unless expressly authorized in writing by HomeFlex.

4. Listings & Property Information

You are solely responsible for the accuracy of all information, photos, and materials you submit in connection with a property listing, including but not limited to property details, condition, and disclosures. You represent that you have the legal authority to list the property and to market it for sale.

For MLS-listed properties, your listing will be submitted to the applicable Multiple Listing Service by Oak & Elm Realty Group LLC pursuant to a separate listing agreement and in accordance with all applicable North Carolina Real Estate Commission (NCREC) rules, MLS regulations, and state and federal laws.

5. Fees & Payment

Certain Services are offered for a fee as described on our Pricing page. Fees for MLS plans are collected at checkout; additional brokerage fees may apply at closing depending on the plan selected and the terms of your listing agreement with Oak & Elm Realty Group LLC. All fees are non-refundable except as expressly stated in these Terms or required by applicable law.

6. Consent to Contact

By creating an account or submitting a listing, you consent to be contacted by HomeFlex and its North Carolina real estate partners (including Oak & Elm Realty Group LLC) via email, telephone, and SMS regarding your property listing, your account, and related services. Standard message and data rates may apply. You may opt out of communications at any time by following the unsubscribe instructions in any message or by contacting us.

7. Showings, Offers & Third Parties

HomeFlex may facilitate requests for property showings and the submission of offers through the platform. We do not guarantee the quality, qualifications, or good faith of any buyer, buyer agent, or other third party you interact with through the Services. You are encouraged to exercise your own judgment and consult a licensed professional before entering into any transaction.

8. Prohibited Conduct

You agree not to misuse the Services, including by submitting false or misleading information, infringing the rights of others, attempting to disrupt or compromise platform security, scraping or harvesting data, or using the Services for any unlawful purpose. Violations may result in suspension or termination of your account.

HomeFlex reserves the right, in its sole discretion, to deny, suspend, or terminate access to the Service if we determine that a user is ineligible, is acting on behalf of third parties without authorization, or is using the Service in a manner inconsistent with its intended purpose.

9. Intellectual Property

The Services, including all content, branding, software, and design, are owned by HomeFlex and protected by applicable intellectual property laws. Listing content and photos you submit remain your property; you grant HomeFlex and its partners a license to use, reproduce, and display them in connection with marketing your property and operating the Services.

10. Disclaimers & Limitation of Liability

The Services are provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by law, HomeFlex shall not be liable for any indirect, incidental, consequential, or punitive damages, or for any loss arising from your use of the Services, interactions with third parties, or reliance on listing or market information made available through the platform.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
